BidFlex ("BidFlex," "we," "us," or "our") operates a public leaderboard where users may pay cryptocurrency, including USDC, to occupy a numbered position that is publicly visible and may subsequently be taken by another user through a higher qualifying payment.
BidFlex positions are provided solely for display, entertainment, and visibility purposes. A leaderboard position does not represent ownership of any asset, company, security, financial instrument, or other property.
Payments made through BidFlex are payments for the applicable digital display and leaderboard placement service. They are not investments, deposits, securities, loans, wagers, or purchases of financial products.
BidFlex does not provide interest, dividends, yield, profit sharing, investment returns, or any other financial return to users.
A leaderboard position has no guaranteed monetary value, resale value, ownership value, or future value. Users should not purchase a position with the expectation that they will recover their payment or make a profit.
Cryptocurrency transactions are generally irreversible once confirmed on the applicable blockchain. By initiating a payment, you acknowledge and agree that:
Except where a refund is required by applicable law, payments made through BidFlex are final and non-refundable.
Being outbid, losing a leaderboard position, voluntarily leaving the service, account restrictions, service interruptions, or dissatisfaction with a position does not create a right to a refund.
You must be at least 18 years old, or the applicable age of majority in your jurisdiction if higher, to use BidFlex.
You are solely responsible for determining whether your use of BidFlex, cryptocurrency transactions, and participation in the service are legal in your jurisdiction.
BidFlex does not guarantee that the service is available or appropriate for use in every jurisdiction.
You may not use BidFlex to:
BidFlex is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.
We do not guarantee that BidFlex will always be available, uninterrupted, secure, accurate, complete, error-free, or free from delays, bugs, or technical problems.
We do not guarantee that cryptocurrency payments will be processed within any particular period of time or that blockchain transactions will be confirmed successfully.
To the maximum extent permitted by applicable law, BidFlex and its operators, owners, affiliates, service providers, and contributors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the service.
This includes, without limitation, losses arising from cryptocurrency transfers, incorrect addresses, incorrect networks, blockchain interruptions, network fees, wallet failures, exchange failures, unauthorized access, account restrictions, service interruptions, technical errors, loss of leaderboard positions, or loss of expected value.
To the maximum extent permitted by applicable law, BidFlex's total aggregate liability for any claim relating to the service shall not exceed the amount actually paid by you to BidFlex in the specific transaction giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
Your chosen username, leaderboard position, bid amount, and certain bid history may be publicly visible to anyone who visits BidFlex.
You are responsible for choosing a username that does not disclose personal information you do not want publicly displayed.
BidFlex may modify, suspend, restrict, or discontinue any part of the service at any time, with or without notice, to the maximum extent permitted by applicable law.
This may include changes to leaderboard functionality, supported cryptocurrencies, supported networks, payment processing, account functionality, pricing, display features, or other aspects of the service.
We reserve the right to suspend, restrict, or terminate access to BidFlex and/or remove a leaderboard position when we reasonably believe it is necessary, including in connection with suspected fraud, abuse, manipulation, unlawful activity, violations of these Terms, or security concerns.
Except where a refund is required by applicable law, termination, suspension, or removal of a position does not create a right to a refund.
We may update these Terms of Service from time to time. Updated Terms become effective when published on the BidFlex website unless otherwise stated.
Your continued use of BidFlex after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
